Draft. This text is still being reviewed and may change before the app launches. If you have any questions, write to us.

These terms are the agreement between you and [TO CONFIRM: name of the responsible person or entity] (“we”) for using Bonsaiku, in the app and on the web. By creating an account or using the service, you accept these terms and the privacy policy.

1. The service

Bonsaiku is a bonsai diary: you record your trees and what you do to them, keep photos, get reminders and a care guide by species and season, and print QR labels for your trees and pots. The app works offline and syncs when you are back online.

The service is free. [TO CONFIRM: whether there will be paid features and on what terms.] We may add, change or remove features; if a change affects you significantly, we will let you know in the app.

2. Your account

  • You sign in with your Google account (and, later, with your Apple account). You must be at least [TO CONFIRM: minimum age] years old.
  • You are responsible for what happens in your account. If you think someone is using it without permission, end your sessions and write to us.
  • The information you give must be true, especially if you request a verified professional profile.

3. Your content

Your trees, entries, photos and texts remain yours. For the service to work, you allow us to store them, convert them (for example, photos to WebP without metadata), copy them between your devices and show them to other people only as far as you choose (unlisted or public labels, public professional profile). This permission ends when you delete the content or your account.

You may only upload content you have the right to use. If you post photos of other people’s trees or work, make sure you have their permission.

Nothing enters your diary without your approval: work proposals made by professionals through the label wait until you approve them.

4. Acceptable use

You may not:

  • upload content that is illegal, offensive, misleading or that infringes the rights of others;
  • pretend to be another person, a professional or an organisation you are not;
  • try to access other people’s accounts, trees or data, or get around the visibility rules;
  • overload, bulk-copy or attack the service, or use it by automated means without permission;
  • use QR labels to lead other people to misleading or dangerous content.

If you do not follow these terms, we may remove content, suspend or close the account. Whenever possible we will warn you first and explain why.

5. The care guide

The guide, the rules per species and the suggested tasks are supporting information. We show the source and confidence level of each rule, but every tree, climate and growing setup is different: the decision to act, and when, is yours.

Treatments and plant protection products must be used as the label and the law in your country say. We are not responsible for losses or damage to trees resulting from following the guide.

6. Professional profiles and credits

A professional profile (bonsai professional, potter or organisation) is only verified after we review it. We may refuse or withdraw verification if the information is not accurate. Credits on a tree only appear on the profile if the tree is public and the professional wants them to.

We do not handle payments between users and professionals. Any arrangement between you is solely between you.

7. Availability

We do our best to keep the service available and to make sure you do not lose data, but we cannot guarantee that it will work without interruptions or errors. We recommend exporting your data from time to time.

8. Ending

You can stop using the service whenever you want and delete your account in the app, under Profile › Advanced › Delete account. Deleting your account deletes all your data and cannot be undone.

If we decide to end the service, we will give you at least [TO CONFIRM: notice period, for example 60 days] notice, so you can export your data.

9. Liability

To the extent permitted by law, we are not liable for indirect damage or for loss of data, trees or opportunities resulting from use of the service. Nothing in these terms limits the rights the law gives you as a consumer.

10. Changes to these terms

We may change these terms. We update the date at the top of the page and, if the change is significant, we let you know in the app before it takes effect. If you do not agree, you can delete your account.

11. Governing law and disputes

These terms are governed by Portuguese law. [TO CONFIRM: competent court and alternative consumer dispute resolution body.] If you have a problem, write to us first: we always try to solve it with you.
